Terms and Conditions for Accommodation Contract

Article I Scope of Application

The Accommodation Contract between the Hotel and the guest and agreements pertaining thereto shall be stipulated in this Contract.Items not stipulated in this Contract shall adhere to laws and normally established customs.
When there is a special agreement with the Hotel without conflicting with laws and customs, this special agreement shall be given priority regardless of the previous stipulation.

Article II Application for the Accommodation Contract
  • 1.Those who apply for an Accommodation Contract with the Hotel shall provide the following to the Hotel.
    • 1)Guest name
    • 2)Dates)of stay and scheduled time of arrival
    • 3)Accommodation fee according, in principle, to the basic accommodation fees listed in Appendix I)
    • 4)Other items deemed necessary by the Hotel
  • 2. When there are changes to the items provided to the Hotel based on the previous provision, the guest shall immediately inform the Hotel of the changes.
  • 3.When the guest requests a continuance of stay exceeding the number of days from section (12)above during their stay, the Hotel shall consider this a new application for an Accommodation Contract at the time of the request.
Article III Conclusion, etc.of Accommodations Contract
  • 1.The Accommodation Contract is established when the Hotel accepts the application in the previous Article.However, the same shall not apply when the Hotel proves that it has not accepted the application.
  • 2.When the Accommodation Contract has been concluded based on the provisions of the previous paragraph, the guest shall pay the accommodation fees for the entire period of stay based on the Accommodation Contract before the start of the stay or by the day designated by the Hotel.
  • 3.When one of the following occurs, the Hotel can deem that the application has not been made regardless of actual intention to stay at the Hotel and the Accommodation Contract becomes invalid.
    • 1)When there is no payment of the above-referenced fees before the start of the stay or by the day designated by the Hotel as stipulated in the previous paragraph.
    • 2)When the Hotel is unable to contact the guest in trying to contact the contact information provided under section 1 of the previous Article within 10 days of the first contact However, when the number of days until the day of staying is less than this, until 1:00AM on the day after the scheduled stay when a scheduled arrival time has been indicated beforehand, the time 1 hour after such time)).
    • 3)When the contact from the Hotel is rejected.
  • 4.In the case of the previous Items (2)and (3), accommodation fees that have already been received will not be refunded.
Article IV Refusal of Accommodation Contract

The Hotel may not accept the conclusion of an Accommodation Contract in the following cases.

  • 1)When the accommodation application does not follow this Contract.
  • 2)When we cannot provide a room due to full occupancy.
  • 3)When, due to the occurrence of natural disasters or other emergencies, the necessity to provide rooms is expected on a priority basis for the victims or people helping in restoration activities, and other situations equivalent to the above paragraph.
  • 4)When the party with the intent to stay is a member of, or related party to an organized crime group, organization related thereto or anti-social force stipulated by the Act on Prevention of Unjust Acts by Organized Crime Group Members or prefectural ordinances for the removal of organized crime groups.
  • 5)When the party with the intent to stay is deemed to pose the risk of violating legal stipulations, public order or morality pertaining to the stay.
  • 6)When the party with the intent to stay is recognized clearly to have a contagious disease.
  • 7)When services and other burdens that exceed the appropriate scope of socially acceptable ideas are requested pertaining to the stay.
  • 8)When it is not possible to offer accommodations due to natural disaster, facilities problems or other inevitable reasons.
  • 9)When the party with the intent to stay poses the risk of inconveniencing other guests, damaging the business of the Hotel due to reasons such as being intoxicated or behaving in a manner which inconveniences other guests or Hotel staff.
  • 10)When the party with the intent to stay is clearly not mentally or physically sound.
  • 11)When minors ages 13-20 children 12 and under are not permitted to stay))without permission of their guardians intend to stay overnight.
  • 12)When the applicant applies for accommodations with the purpose of transferring the right to stay to another person.
  • 13)When the applicant applies without actual intent to stay.
  • 14)Other cases that fall under the situations where a stay can be refused pursuant to the relevant laws and prefectural ordinances, etc.
Article V Right of the Guest to Cancel the Contract
  • 1.The guest can cancel the Accommodation Contract by notifying the Hotel.
  • 2.When the guest cancels all or part of the Accommodation Contract based on the previous section, they shall pay a cancellation fee based on Appendix II.
  • 3.When the guest has not arrived at the scheduled arrival time on the day of staying overnight without contacting the Hotel, the Hotel can consider this a cancellation of this Accommodation Contract by the guest.
Article VI Right of the Hotel to Cancel the Contract
  • 1.The Hotel can cancel the Accommodation Contract in the following cases.
    • 1)When the guest is a member or related party to an organized crime group, organization related thereto or anti-social force stipulated by the Act on Prevention of Unjust Acts by Organized Crime Group Members or prefectural ordinances for the removal of organized crime groups.
    • 2)When the guest carries out violence, intimidation, threats, unfair demands, gambling, possession or usage of narcotics, guns or blades not permitted by law, actions which inconvenience other guests, actions which violate other laws or public order, or poses the risk of these actions.
    • 3)When the guest is recognized clearly to have a contagious disease.
    • 4)When services or other burdens that exceed the appropriate scope of socially acceptable ideas are requested pertaining to the stay.
    • 5)When it is not possible to offer accommodations due to natural disaster, facilities problems or other inevitable reasons.
    • 6)When the guest obstructs fire prevention such as smoking while lying down in the room or tampering with fire extinguishing equipment.
    • 7)When the guest transfers or attempts to transfer their right to stay overnight.
    • 8)When the payment of accommodation fees by the travel agency is not confirmed when the Accommodation Contract is concluded through a travel agency.
      Such inability to confirm the payment of accommodation fees includes the cases when the payment is made through transfer immediately before the close of the financial institution’s operation hours or when the banking transactions are carried out online regardless of the financial institution’s operation hours and the transfer cannot be confirmed due to the following day being a day off for the financial institution.
    • 9)When there is a violation of this Contract or the Hotel’s Usage Regulations.
    • 10)Other cases that fall under the situations where a stay can be refused pursuant to the relevant laws and prefectural ordinances, etc.
  • 2.Notification of cancellation based on the previous section shall be carried out orally or by phone, e-mail or in writing to the contact information of the guest provided based on Article II.When the notification is sent to the contact information provided based on Article II but it does not arrive, in addition to applying the stipulations from Article III 3), it can be considered as having arrived at the time for which it would normally take to arrive.
  • 3.When the Hotel cancels the Accommodation Contract based on the previous section 2, a refund of the accommodation fees will not be made excluding cases listed in section (1)(3)and (5).
Article VII Registration
  • 1.The guest shall register the following information at the Hotel front desk on the day of staying.
    • 1)Name, age, gender, address and occupation of the guest.
    • 2)Nationality, passport number, place of entry to Japan, date of entry to Japan, with presentation of passport and copy of the passport, when the guest is a foreigner.
    • 3)Date of departure and scheduled time of departure.
    • 4)Other information the Hotel deems necessary.
  • 2.When the guest makes payment of fees listed in Article XI using methods that are alternative to currency such as accommodation voucher or credit card, etc., they shall present these beforehand at time of registration referenced in the previous section.
Article VIII Usage Time of Room
  • 1.The time that the guest can use the Hotel room is from the check-in time to the check-out time 10:00 AM)stipulated by the Hotel.
  • 2.The Hotel may agree to the use of the room outside the times stipulated in the previous section regardless of the provisions thereof.In this case, there is an additional fee payable including consumption tax)as stipulated in Appendix III.However, when the departure time has exceeded the check-in time on the scheduled date of departure, or usage of room begins before the check-out time on the day of arrival, we ask for payment of fee for one additional day.
  • 3.Even within the time the guest can use the room based on the previous section 2, when it is necessary for maintaining safety, sanitary conditions or other Hotel administration, the Hotel personnel can enter the room and take necessary measures.
Article IX Adherence to Usage Regulations

The customer shall adhere to the Usage Regulations display in the Hotel set by the Hotel.

Article X Operation Hours
  • 1.The operating hours of facilities in the Hotel are listed on items such as Hotel pamphlets, displays and information books in rooms, etc.
  • 2.Operating hours of facilities of the previous section may change temporarily in necessary or inevitable cases.We will make proper notification in this case.
Article XI Payment of Fees
  • 1.The breakdown of fees, etc.which the guest must pay are listed in Appendix I.
  • 2.Payment of fees, etc.of the previous section shall be made at the front desk when the customer arrives or when the Hotel requests payment by cash or other methods in place thereof, such as accommodation vouchers accepted by the Hotel and credit card, etc.
  • 3.Accommodation fees shall be due and payable even when the guest voluntarily decides not to stay after the Hotel provides the guest with a room and enables the guest to use it.
Article XII Responsibility for Overnight Stay
  • 1.The Hotel shall compensate the guest for damages if the Hotel has caused damage to the guest in the fulfillment or nonfulfillment of the Accommodation Contract or related contracts.However, the same shall not apply in cases in which such damage has been caused due to reasons for which the Hotel is not liable.
  • 2.The Hotel is enrolled in innkeeper’s liability insurance to cover the damage of the guest referenced in the previous section.However, when the damage is exempted from the insurance contract, the damage suffered by the guest may not be compensated.
Article XIII Procedures when a Contracted Room cannot be Provided
  • 1.When the Hotel cannot provide a room to a guest who has established a contract, the Hotel shall arrange another accommodation facility of the same standard elsewhere for the guest insofar as practicable with the consent of the guest.
  • 2.When the Hotel cannot arrange another accommodation facility notwithstanding the efforts made pursuant to the previous section, the Accommodation Contract can be cancelled.Notification of cancellation in this case shall follow the stipulations in Article VI 2).
  • When the Hotel cannot provide a room due to reasons which are the responsibility of the Hotel, the Hotel shall pay a compensation fee to the guest based on Appendix IV, and this compensation fee shall be considered compensation for damages.
Article XIV Handling of Deposited Items
  • 1.When items that the guest deposits with the front desk excluding cash and valuables)are lost, broken or otherwise damaged, the Hotel shall compensate for these damages, except in the case when this has occurred due to causes of force majeure. However, cash and valuables are the personal responsibility of the guest and shall be kept in the valuables locker.The Hotel cannot take any responsibility for these.
  • 2.When items that the guest brings into the Hotel excluding cash and valuables)but does not deposit with the front desk are lost, broken or otherwise damaged due to the intent or negligence of the Hotel, the Hotel shall compensate the guest for these damages.However, for items of which the nature and value has not been reported in advance by the Hotel shall compensate the guest up to a maximum of 50,000 yen, except where the Hotel is liable for intent or gross negligence.
Article XV Storage of the Guest’s Personal Effects and Belongings
  • 1.When the guest’s personal effects excluding cash and valuables, hereinafter the same)are brought into the Hotel before the arrival of the guest, the Hotel shall store these only when the Hotel has consented to before the arrival.
  • 2.When guests leave or forget personal effects or belongings after check-out, the Hotel shall keep these for 7 days from the date of discovery and take them to the nearest police station based on applicable laws when there is no indication from the owner or the owner cannot be identified.
  • 3.The Hotel can inspect the contents of personal effects and belongings voluntarily and return them to the person who lost them or take measures according to the previous section in order to take proper measures according to the properties thereof , and the guest cannot object to this.
  • 4.Responsibility of the Hotel for the storage of personal effects and belongings of the guest in the cases of sections 1 and 2 shall conform to the stipulations in section 1 of the preceding Article in the case of section 1, and to the stipulations in section 2 of the same Article in the case of the preceding section.
Article XVI Personal Effects when Using the Bathing Area
  • 1.When using the bathing area, valuables including cash, hereinafter the same in this Article)and the room key shall be stored in the valuables locker according to its intended usage.
  • 2.Handling of items stored in the valuables locker or kept at the front desk shall adhere to the stipulations in Article XIV.
  • 3.Damage caused by theft for not following section 1, such as keeping valuables in the clothes basket, is not the responsibility of the Hotel.However, the Hotel shall compensate for up to 10,000 yen in damages when the Hotel bears responsibility, excluding cases of intent or gross negligence by the Hotel.
Article XVII Responsibility of the Guest

When the Hotel incurs damage due to the intent or negligence of the guest, said guest shall compensate the Hotel for the damages.

Article XVIII Cleaning the Room
  • 1.When the guest stays in the same room for 2 consecutive nights or More, cleaning of the room will be carried out every day as a rule by the Hotel.
  • 2.Even when there is a request from the guest that cleaning is not necessary, cleaning of the room shall be carried out at least once every 3 days in accordance with laws and prefectural ordinances.However, the Hotel can clean the room anytime when it deems necessary.
  • 3.The guest cannot refuse cleaning of the room of the previous section.
Article XIX Revisions to the Contract

This Contract can be revised at any time as necessary.
When this Contract is revised, the Hotel shall list the revised Contract and effective date on the Hotel’s homepage.

  • Attn.1)The percentage is the cancellation fee percentage in regards to the accommodation fee including tie-up fees with tie-up accommodation plans with other businesses).
    When the calculated price according to cancellation policies set by other tie-up businesses is More than the cancellation fee calculated based on the table above, the former shall be paid as the cancellation fee.
  • Attn.2)When the number of contracted days is reduced, cancellation fees shall be charged only for the first day in which the guest does not stay overnight due to the reduction of days regardless of the number of days reduced.However, the cancellation fee listed in the above Appendix II shall be charged based on the number of days from the day the reduction was requested to each day the guest does not stay overnight for the total amount of days in which the guest does not stay overnight due to the reduction of days.
  • Attn.3)When there is a cancellation of the contract for some of the guests, the cancellation fee shall be calculated based on the accommodation fees for the number of people who cancel the contract.
Appendix III Additional Fess from Usage Outside of Room Usage Times pertaining to Article VIII)

Additional fees based on Article VIII 2)of the Accommodation Contract shall be as follows.Amounts based on excessive fee calculation shall be the calculated as the amount from adding consumption tax to the basic accommodations fees for the final day of stay.
